Motor Vehicle Accident

Rear-End Collision — Chronic Soft Tissue Injuries

Situation

Client was stopped at a red light on a Toronto highway when struck from behind at approximately 60 km/h. The client suffered whiplash, chronic neck pain, and lower back injuries that persisted for over 18 months.

Challenge

The insurer argued the injuries were "minor" under the Minor Injury Guideline (MIG) and capped treatment at $3,500. They relied on their own medical assessor who concluded the client had pre-existing degenerative changes.

Our Strategy

We obtained independent medical reports from an orthopaedic specialist and a chronic pain physician documenting that the collision caused new, symptomatic injuries distinct from age-related changes. We moved the client out of MIG and into the non-earner benefit stream, then pursued the at-fault driver's insurer for tort damages.

Result

Settlement achieved above the tort deductible threshold, covering all future treatment costs, income loss, and general damages.

Slip & Fall

Icy Parking Lot Fall — Fractured Wrist & Shoulder Tear

Situation

Client slipped on an unsalted commercial parking lot during a January morning. Sustained a fractured wrist requiring surgery and a rotator cuff tear requiring arthroscopic repair.

Challenge

The property management company denied liability, claiming the lot had been salted the previous evening and blaming the client for wearing inappropriate footwear. They produced a maintenance log showing salt application at 8 PM the night before.

Our Strategy

We retained a meteorological expert who confirmed freezing rain fell between 2–5 AM — after the last salt application. We obtained the property's winter maintenance contract showing they were obligated to re-salt within 4 hours of new precipitation. We also obtained security footage from an adjacent business showing other patrons slipping in the same area.

Result

Case resolved through mediation. Client received compensation for surgical costs, rehabilitation, lost wages during recovery, and pain and suffering.

Workplace Injury

Construction Site Fall — Spinal Fracture

Situation

Construction worker fell from scaffolding at a commercial development site in the GTA after a guardrail failed. Suffered a compression fracture of the lumbar spine requiring fusion surgery.

Challenge

The employer and general contractor blamed the client for not wearing a harness. WSIB initially classified benefits at a lower level. The at-fault parties had multiple layers of subcontractor relationships designed to diffuse liability.

Our Strategy

We pursued both an enhanced WSIB claim and a tort action against the general contractor. Ministry of Labour inspection reports confirmed the guardrail was defective and that the general contractor had been previously cited for fall protection violations on the same site. We retained a structural engineer to demonstrate the guardrail failure was a foreseeable hazard.

Result

WSIB benefits were upgraded. The tort claim was settled, providing long-term compensation for the client's permanent partial disability and future care needs beyond what WSIB covers.

Brain Injury — Pedestrian

Pedestrian Struck in Crosswalk — Traumatic Brain Injury

Situation

Client was lawfully crossing at a signalized intersection in North York when struck by a left-turning vehicle. Suffered a mild traumatic brain injury (mTBI) with persistent post-concussion syndrome, including cognitive difficulties, chronic headaches, and inability to return to professional employment.

Challenge

Defence experts characterized the injury as a "mild" concussion that should have resolved within 3 months. The insurer offered a low settlement based on the assumption of full recovery. The client's symptoms were largely invisible — no fractures, no visible injuries.

Our Strategy

We assembled a multidisciplinary team: neuropsychologist (documenting cognitive decline), occupational therapist (demonstrating inability to perform job tasks), and a neuroradiologist who identified subtle white matter changes on advanced DTI-MRI imaging not visible on standard scans. A vocational rehabilitation expert calculated lifetime earning loss.

Result

Case resolved for significant compensation reflecting the permanent nature of the cognitive impairment, future care requirements, and full lifetime income loss.

Medical Malpractice

Delayed Cancer Diagnosis — Stage Advancement

Situation

Client presented to their family physician with concerning symptoms on multiple occasions over 14 months. Referral to a specialist was delayed. When finally diagnosed, the cancer had advanced from an early treatable stage to a stage requiring aggressive chemotherapy and surgery with reduced prognosis.

Challenge

Medical malpractice cases require expert evidence that the standard of care was breached AND that earlier diagnosis would have changed the outcome ("loss of chance" doctrine). The defence argued the physician acted reasonably given the initial presentation.

Our Strategy

We retained both an oncology expert and a family medicine expert. The oncology expert established that earlier diagnosis would have resulted in a significantly better prognosis with less invasive treatment. The family medicine expert confirmed that the standard of care required timely referral given the presenting symptoms and risk factors.

Result

Case resolved through negotiation, compensating the client for the additional treatment burden, pain and suffering from the more aggressive treatment, lost income during extended recovery, and diminished life expectancy.

Motorcycle Accident

Left-Turn Collision — Multiple Fractures

Situation

Experienced motorcyclist was proceeding through a green light in Toronto when an oncoming vehicle turned left into their path. Client suffered compound fractures to the leg, a broken collarbone, and road rash requiring skin grafts.

Challenge

The at-fault driver claimed the motorcyclist was speeding, attempting to establish contributory negligence to reduce the payout. The insurer's biomechanical expert argued the injuries were less severe than claimed.

Our Strategy

We obtained traffic camera footage establishing the client was within the speed limit. Our accident reconstruction expert confirmed the at-fault driver had insufficient gap time to complete the left turn safely. An independent orthopaedic assessment documented the permanent hardware in the client's leg and ongoing mobility limitations.

Result

Full liability established on the at-fault driver. Settlement included compensation for three surgeries, extensive physiotherapy, permanent scarring, chronic pain, and significant income loss during the 14-month recovery.
