$1.2M Recovery for Toronto Pedestrian Hit by Distracted Driver

· LSO #51731A

Names changed; facts and outcome are real

Quick Facts

Client: 47-yr-old IT consultant
Location: East York
Injuries: Moderate TBI + fractures
Scene: Yonge & Bloor
Recovery: $1.2 million
Timeline: 28 months

The Accident

"M." (client name protected) was crossing Yonge Street at Bloor on a Tuesday afternoon, walking with the pedestrian signal. A 28-year-old driver looking down at their phone made a right turn from Bloor onto Yonge without checking for pedestrians. The vehicle struck M. at approximately 25 km/h, throwing them forward onto the pavement.

M. was unconscious at the scene for several minutes. Paramedics transported M. to St. Michael's Hospital. Initial diagnosis: concussion, fractured left tibia, fractured ribs, deep contusions. CT imaging the next day revealed a small subdural hematoma.

The Insurance Reality

Within 48 hours, the at-fault driver's insurer called M.'s spouse offering a $20,000 "compassion settlement" to close the file. The adjuster framed it as helpful — "to cover initial expenses while M. recovers." It would have permanently barred M. from any further claim.

M.'s spouse, fortunately, did not sign. Instead they searched for a Toronto personal injury lawyer and found Kanevsky Law. Olga met them at the hospital the next day.

The Initial Strategy

Three things had to happen immediately:

  1. SABS application filed within the 30-day window — locking in income replacement and medical coverage
  2. Evidence preservation — Toronto Police accident reconstruction, CCTV from intersection retailers, cell phone records, witness statements
  3. Independent medical assessments — neurology, neuropsychology, and orthopaedic specialists

The defence-side insurer's first formal offer (90 days in): $75,000.

The Catastrophic Impairment Determination

Six months post-accident, M. was struggling. The leg fracture healed, but cognitive symptoms persisted — difficulty concentrating, memory lapses, headaches, mood changes.

Olga retained a specialist neuropsychologist who conducted comprehensive testing. The result: documented evidence of moderate cognitive impairment consistent with post-concussion syndrome. Combined with the orthopaedic findings, this supported a catastrophic impairment designation under Ontario's SABS framework.

Catastrophic impairment unlocked:

  • $1 million in SABS medical/rehab coverage (up from the standard $65,000)
  • $1 million in attendant care benefits
  • Significantly stronger tort case for general damages

The Settlement

Three weeks before the scheduled trial date, the defence settled for $1.05 million in tort damages. Combined with the SABS benefits already paid through the file, M.'s total recovery exceeded $1.2 million.

What This Case Illustrates

  1. The "compassion settlement" trap is real. If M.'s spouse had signed the $20,000 release, the recovery would have stopped there. Permanently.
  2. Catastrophic impairment determinations require expert evidence — which requires the right lawyer to know when and how to commission them.
  3. Trial preparation, not trial itself, often unlocks the best settlements.
  4. "Mild" traumatic brain injuries are anything but.
  5. The full recovery took 28 months. Meanwhile, SABS covered M.'s ongoing medical care.
