A concussion is a brain injury. If symptoms persist past a few weeks, the claim value changes dramatically — and catastrophic impairment unlocks $1 million in SABS benefits.
"Mild" Traumatic Brain Injury Is a Misleading Label
A concussion is, medically, a mild traumatic brain injury (mTBI). The word "mild" describes how the injury presented at the moment of impact — not how it will affect your life. Many of the most financially devastating claims we handle in Mississauga began as a concussion that a hospital discharged the same evening.
The reason is straightforward: cognitive impairment attacks earning capacity. A physical injury may stop you lifting; a brain injury can stop you concentrating, managing complexity, tolerating noise, or holding a conversation in a meeting. For anyone in a knowledge-based role, that is a career-level loss.
The Proof Problem — And How We Solve It
Concussions rarely appear on a standard CT or MRI. Insurers exploit this relentlessly: no imaging finding, therefore no objective injury, therefore a minor claim. Overcoming that argument is an evidence exercise, and it must start early:
- Neuropsychological testing — the single most persuasive evidence, objectively measuring memory, processing speed and executive function
- Specialist neurology and physiatry assessments, not just a family doctor's note
- A contemporaneous symptom diary — headaches, light and noise sensitivity, sleep disruption, mood changes
- Corroboration from family and employers — the people who notice the changes you cannot see in yourself
- Functional capacity evaluation tying impairment to real work tasks
Expect the insurer to send you for an independent medical examination. Read our IME survival guide before you attend.
Catastrophic Impairment: The $1 Million Threshold
This designation is the most consequential decision in a serious Mississauga brain injury file. Standard Accident Benefits cap medical and rehabilitation at $65,000. A catastrophic impairment determination raises that to $1 million for medical/rehab plus $1 million for attendant care, and it also strengthens the tort claim considerably. Meeting the test requires the right specialist evidence, commissioned at the right time — which is why the choice of counsel early matters so much.
